For a period of 10 years from the date of formalization of the credit contract. The Public Guarantee serves as additional security for the bank, allowing better financing conditions for the client. After the end of these 10 years, the guarantee automatically ends, and the credit follows the normal rules, without the State's support as a guarantor.
In the event of default, the bank activates the Public Guarantee, and the State temporarily assumes the payment of the amount owed. However, the client remains responsible for that amount and must settle it with the financial institution. After this settlement, the bank reimburses the amount to the State. In other words, the guarantee protects the bank but does not exempt the client from their obligations.
Yes. During the guarantee period, you can renegotiate the terms of your credit, such as the term or interest rate, without losing this benefit. All of this is subject to the bank accepting the changes. The existence of the Public Guarantee does not prevent these renegotiations, nor does it invalidate the contract.
Yes, it is possible to transfer the credit, provided that the new bank has adhered to the Public Guarantee protocol. However, you should be aware that the guarantee is not renewed with the transfer; it only remains for the remaining time of the initial 10-year term. This means that, for example, if you have already benefited from the guarantee for 6 years, when you transfer the credit, it will only remain for another 4 years.
This measure is valid for credit contracts signed until December 31, 2026.
Yes. It is possible to benefit from the Public Guarantee and simultaneously enjoy the total or partial exemption from IMT and Stamp Duty, provided you meet the respective requirements.
No. This measure has no retroactive effects. This means it only applies to credit contracts signed after the publication of the legislation, which occurred in September 2024. In other words, mortgages signed before that date cannot benefit from this measure, even if the client meets all other criteria.
It depends on the situation of each buyer. The exemption from IMT and Stamp Duty applies only to the buyer who does not own another property in their name and who meets the other criteria of the measure. If one of the buyers already owns another property, that person does not benefit from the exemption and will have to pay the taxes corresponding to their share of the acquisition. The other buyer, if they meet the requirements, may benefit from the exemption.
No. Young people who are considered dependents for tax purposes in the year of purchase are not eligible for these measures. This is because, to benefit from the support, the buyer must be fiscally independent, meaning they must have their own tax return and fiscal autonomy. If they are still part of another person's household as a dependent, they do not meet the necessary requirements.
No. The exemption applies exclusively to the acquisition of properties intended for permanent and primary residence. This means it does not cover: loans for works or renovations, land purchases, and other types of financing that do not involve the direct acquisition of a house for personal residence. It is important to note that, in the case of purchasing land for building a house, the IMT only applies to the value of the land, not the cost of construction. However, this situation is not covered by the exemption provided for in this measure.
No. Although Life Insurance and Multi-risk Home Insurance are required by banks as a condition for granting credit, you are not obliged to take them out with the same institution where you make the loan. You can freely choose the insurer that offers you the best conditions, as long as the coverages meet the minimum requirements set by the bank. Often, taking out insurance outside the bank allows for a better price/coverage ratio, which can represent significant savings over time.
Yes. Despite the Public Guarantee and tax exemptions, there are some costs that remain the responsibility of the client:• Stamp Duty on the financed amount• Bank fees, such as property appraisal and contract formalization• Mandatory insurances (Life Insurance and Multi-risk Home Insurance)These charges are part of the normal process of taking out a mortgage and are not covered by the exemptions provided for in this measure.
No, during the guarantee period, it is not possible to rent the property. The State Guarantee, granted to young people up to 35 years old, lasts for 10 years. During this period, the property must be exclusively intended for primary and permanent residence.This means that:• It cannot be rented• It must be the beneficiary's habitual residenceAfter the end of the 10-year guarantee, this specific obligation no longer exists, and the property can be rented or sold without restrictions associated with this measure.
